Estep approves pleas

Judge Robert Estep approved several plea agreements recently during hearings in Claiborne County Sessions Court.

Christopher D. Green (aka Greene), 30, charged with evading arrest, resisting arrest and theft under $500, was sentenced to 11 months, 29 days confinement. Green must pay $500 in restitution to his victim and is barred from any unlawful contact with him. He must stay off the property of Vyve Cable Company. This sentence runs concurrently with prior cases.

Christal Lee McVey, 43, charged with criminal trespassing and theft under $500, was sentenced to 11 months, 29 days ETHRA supervised probation. McVey must pay at least $78 per month in court costs and fines beginning Jan. 8. She forfeits $75 to the Economic Crime Fund. McVey is barred from the premises of Walmart and Walgreens stores.

Under a separate violation of probation warrant, McVey is charged with failure to report to probation and nonpayment of court costs, fines and supervision fees while on probation. She was sentenced on this case to 15 days confinement and ordered to remain on supervised probation for six months. McVey was given credit for 15 days jail time already served on this case.

Dixie Ann Russell, 28, was charged with passing worthless checks and driving on a suspended license. Russell was granted a deferred judgment of one year and sentenced to 11 months, 29 days ETHRA supervised probation with four days confinement (credit for four days jail time already served). She must pay at least $150 per month in court costs and fines and forfeits $300 to the Economic Crime Fund. Russell must pay $839.18 in restitution to Lee’s Food Mart, located on Hwy. 25E north. Her driver’s license is revoked per the Dept. of Safety.

Diania Simpson, 54, charged with driving under the influence (second offense), was sentenced to 11 months, 29 days ETHRA supervised probation with 45 days confinement. Simpson was given credit for 29 days and 16 hours of jail time served in Harlan County, Kentucky. She was given additional unspecified credit for all pretrial time spent incarcerated, as well. Simpson must pay at least $75 per month in court costs and fines and must complete a MADD Victim Impact Panel. Her driver’s license is revoked for two years.

Todd M. Hamlin, 41, charged with driving under the influence (second offense), was sentenced to 11 months, 29 days ETHRA supervised probation with 45 days confinement. Hamlin was given credit for 28 days jail time in exchange for completing an inpatient rehabilitation program. He must pay at least $100 per month in court costs and fines and complete a MADD Victim Impact Panel. His driver’s license is revoked for two years.

James Michael Roberts, 36, charged under multiple cases with three counts of driving under the influence, was sentenced to two years ETHRA supervised probation with 45 days confinement (credit for four days jail time already served). Roberts must pay at least $75 per month in court costs and fines beginning 30 days after his release from jail. He must complete a MADD Victim Impact Panel and attend DUI School. His driver’s license is revoked per the Dept. of Safety.

Sammie Zackery Carroll, 19, charged with theft under $500, was sentenced to 11 months, 29 days ETHRA supervised probation. Carroll must pay at least $75 per month in court costs and fines beginning 30 days after release from jail. He must pay $103.73 in restitution to Walmart and forfeits $75 to the Economic Crime Fund. Carroll is barred from the premises of any Walmart store.

This sentence runs concurrently with a violation of probation case in which Carroll was charged with failure to report to probation, to submit to random drug screenings, to complete an alcohol and drug assessment and for nonpayment of court costs, fines and supervision fees while on probation. He was sentenced in this case to 60 days in jail and ordered to remain on supervised probation for 11 months, 29 days. Carroll was given credit for 15 days of jail time already served.

Dustin Carl Johnson, 30, charged with theft under $500, was sentenced to 11 months, 29 days confinement and ordered to pay $27.31 in restitution to the Tazewell Food City Store. This sentence runs concurrently with a prior violation of probation case.

Taylor Brook McNew, 20, charged with theft under $500, was granted a deferred judgment of one year and sentenced to 11 months, 29 days ETHRA supervised probation. McNew must pay at least $75 per month in court costs and fines and forfeits $75 to the Economic Crime Fund. She is barred from any contact with her victims and must stay away from their property. McNew is eligible for unsupervised probation, after a minimum three month period, once found fully compliant.
