Sexton handles criminal plea agreements

Judge Shayne Sexton handled several plea agreements recently during sessions in Claiborne County Criminal Court.

Myrl Edward Rodgers, 46, charged with driving under the influence, was sentenced to a split confinement of 11 months, 29 days ETHRA supervised probation with three days confinement. Rodgers was given credit for 18 hours of jail time already served. He must pay at least $150 per month including court costs and a $350 fine and must attend the MADD Victim Impact Panel. His driver’s license is revoked for one year. Rodgers is eligible for unsupervised probation once found fully compliant.

Gregory Harville, 29, initially charged with driving under the influence, driving on a suspended license and violations of the implied consent and financial responsibility laws, was sentenced to a split confinement of one year ETHRA supervised probation with two days confinement for the charge of driving under the influence. The other charges were dismissed. Harville was given credit for two days jail time already served. He must pay at least $150 per month including court costs and a $350 fine and must attend the MADD Victim Impact Panel.

Danny Alan Wilcoxson, 51, was initially charged with the sale and delivery of a schedule II controlled substance inside a drug-free zone and the possession of a schedule II and a schedule III drugs with the intent to sell and deliver in a drug-free zone. Wilcoxson was sentenced to ten years Community Corrections for the sale of a schedule II controlled substance and the possession of a schedule III drug with the intent to sell. The remaining charges were dropped. He must pay at least $50 per month including court costs and a $4,000 fine.

Stephanie Anne Smith, 32, charged with possession of a schedule IV drugs with the intent to sell, possession of drug paraphernalia and violation of the seat belt law, was sentenced to a consecutive split confinement of two years ETHRA supervised probation with three days confinement. Smith was given credit for three days jail time already served. She must pay at least $75 per month including court costs and a total $900 in fines. The charge of violating the seat belt law was deemed nolle.

Shauntwan A. Wilson, 32, initially charged with two counts unlawful possession of a weapon and one count each criminal impersonation and possession of a schedule II drugs and drug paraphernalia, was sentenced to one year ETHRA supervised probation. Wilson was sentenced on two of the charges, the unlawful possession of a weapon and possession of drug paraphernalia. He must pay at least $100 per month including court costs and a $150 fine. He forfeits $250 and his rifle to the Tazewell Police Department. Wilson’s handgun may be returned once all probationary conditions are met. He is eligible for unsupervised probation once all monetary obligations are met and he is found fully compliant.

Roger Jones, 30, charged with possession of a schedule II controlled substance with the intent to sell, was sentenced to a split confinement of four years TDOC supervised probation with 26 days confinement. Jones was given credit for 26 days jail time already served. He must pay at least $150 per month including court costs and a $2,000 fine.

Sheila Ann Dummett, 49, initially charged with simple possession of methamphetamine, driving on a suspended license and violation of the financial responsibility law, was sentenced to 11 months, 29 days confinement with credit for 46 days jail time already served. Dummett was sentenced only for simple possession of drug paraphernalia. The methamphetamine charge was amended and the other two charges were dismissed.

Charles Sutton, 34, charged with two counts of theft over $1,000, was sentenced to a concurrent two years TDOC supervised probation. Sutton forfeits $150 to the Economic Crime Fund. Court costs and any restitution will be determined during a hearing on June 27. Sutton is barred from contact with his victims. This case runs concurrently with prior ones.

Terry D. Herrell, 36, charged with theft over $1,000, was sentenced to a split confinement of eight years TDOC supervised probation with seven months confinement. Herrell was given credit for seven months jail time already served. He must pay at least $50 per month in court costs and forfeits $75 to the Economic Crime Fund. Herrell is barred from any contact with his victim.

Jody Troutman, 46, initially charged with theft under $500 and possession of drug paraphernalia, was sentenced to six months unsupervised probation for the amended charge of attempted theft under $500. The possession charge was dismissed. As a condition of her probationary status, Troutman must pay all court costs and fines in full by Nov. 7. She forfeits $75 to the Economic Crime Fund.

Sara Rena West, 32, charged with theft over $500, was sentenced to two years at 30 percent confinement with credit for 46 days jail time already served. West may apply under the terms of her plea agreement to the Eighth Judicial District Drug Court. This case runs concurrently with a violation of probation case.
