Judge Robert Estep processed several plea agreements recently during hearings in Claiborne Sessions Court.
Dennis Evans, 47, charged with driving under the influence (second offense), was sentenced to 11 months, 29 days ETHRA supervised probation with 45 days confinement. Evans was given credit for any jail time already served. He must pay at least $125 in court costs and fines. Evans must attend a MADD Victim Impact Panel. His driver’s license is revoked for two years. Evans is eligible for unsupervised probation once all monetary obligations are met and he is found fully compliant.
Christian B. Campbell, 24, charged with driving under the influence and possession of drug paraphernalia, was sentenced to two years probation with credit for five days jail time already served. Campbell has completed 30 days in an inpatient rehabilitation program and 222 days inside a residential treatment facility. As a condition of his current status, he must remain in a residential treatment facility in lieu of serving the balance of his sentence in full, without credit for jail and time in treatment. This case will be reviewed on June 14, 2018.
Joshua Nelson, 33, charged with driving under the influence and possession of drug paraphernalia, was sentenced to 11 months, 29 days ETHRA supervised probation with seven days confinement. Nelson was given credit for seven days jail time already served. He must pay at least $150 per month in court costs and fines. Nelson must complete a MADD Victim Impact Panel and agrees to forfeit his firearm and all seized property.
Linda Sue Gulley, 64, charged with driving under the influence, was sentenced to 11 months, 29 days ETHRA supervised probation with two days confinement. Gulley was given credit for any time already served. She must pay at least $100 per month in court costs and fines and must complete a MADD Victim Impact Panel. Her driver’s license is revoked per the Dept. of Safety. Gulley is eligible for unsupervised probation once all monetary obligations are met and she is found fully compliant.
Mark Alderman, 43, charged with leaving the scene of an accident, was sentenced to six months probation. He must pay at least $250 per month in court costs and $820 in restitution to his victim. A review date of Jan. 5 is set in this case. Alderman will not need to appear if he has paid all monetary obligations in full, by that time.
Tyler A. Johnson, 19, charged with underage possession of alcohol, was sentenced to 11 months, 29 days ETHRA supervised probation with three days confinement. Johnson was given credit for three days jail time already served. He must pay at least $50 per month in court costs and fines.
Wanda Sue Herbert, 35, charged with solicitation of false report, was sentenced to 11 months, 29 days ETHRA supervised probation. Herbert must pay at least $100 per month in court costs and fines. This case runs concurrently with a violation of probation case in which Herbert was given 60 days confinement with credit for 14 days jail time already served. This probation case included charges of possession of a schedule VI controlled substance, harboring a fugitive, possession of drug paraphernalia, failure to report to probation, to submit to random drug screenings and nonpayment of court costs, fines and supervision fees while on probation.
Heather Jane Ledford, 23, charged with criminal trespassing and theft of merchandise under $500, was sentenced to 11 months, 29 days ETHRA supervised probation with ten days confinement. Ledford was given credit for ten days jail time already served. She must pay at least $75 per month in court costs and fines and forfeits $75 to the Economic Crime Fund. Ledford is barred from the Walmart premises. This case runs concurrently with prior ones.
Daniel Lee Butler, 29, charged with possession of a schedule III drugs, was sentenced to 11 months, 29 days community corrections supervision with one day confinement. Butler was given credit for one day jail time already served. He must pay at least $125 per month in court costs and fines. This case runs concurrently with prior ones.
Edward Buster Hicks, 48, charged with the use of alcohol in an access area, was sentenced to 30 days unsupervised probation. Hicks was given credit for time served. As a condition of his probationary status, Hicks must pay all monetary obligations in full by Oct. 20.
David Brad Henson, 40, charged with theft under $500, was sentenced to 11 months, 29 days EHTRA supervised probation with eight days confinement. Henson was given credit for eight days jail time already served. He must pay at least $75 per month in court costs and fines and forfeits $75 to the Economic Crime Fund. Henson must pay $4.50 in restitution to the Fresh –N-Low Grocery Store and is barred from the store premises.
Sherry Epperson, 43, charged with attempted theft of merchandise, was sentenced to six months probation. Epperson must pay all court costs and forfeits $75 to the Economic Crime Fund. She must pay $7.01 in restitution to the Cumberland Gap Dollar General Store and is barred from any contact with all Dollar General Stores.
Benny Lane Wayne, 36, charged with attempted theft under $500, was sentenced to six months confinement. Wayne was given credit for jail time already served. This case runs concurrently with prior ones.
